Amending the Fair Work Act to stop Forced FIFO

Together with my LNP colleague, Member for Capricornia Michelle Landry, I am putting forward a bill banning forced FIFO.The continuing stalemate over 100 per cent Fly-In Fly-Out (FIFO) arrangements at some Bowen Basin mines has gone on for far too long and it’s time to take some drastic action.We’re taking the call for action straight to the country’s ultimate regulator – Parliament House, by presenting a bill seeking to amend the Fair Work Act (2009).The amendment will essentially stop discrimination against workers based on where they live.Here's the general wording of the bill.Fair Work Amendment (Prohibiting Discrimination Based On Location) Bill 2015 A Bill for an Act to amend the Fair Work Act 2009, and for related purposesSchedule 1—AmendmentsPart 1—Main amendmentFair Work Act 20091 After section 351Insert:351A Discrimination based where a person lives(1) An employer must not take adverse action against a person who is an employee, or prospective employee, of the employer because of where the person lives.Note: This subsection is a civil remedy provision (see Part 4-1).(2) However, subsection (1) does not apply to action that is taken because of the inherent requirements of the particular position concerned.[Note: This provision relies on the definition of "adverse action" in section 342 of the Act (see in particular items 1 and 2). For the meaning of "employee" and "employer" in this provision see section 335 (the terms have their ordinary meanings) but see also sections 338 and 339 for the constitutional coverage of Part 3-1.]
